TMC ROTTWEILERS Location Florida TMC Buyer's Contract We, The Undersigned, have read and agree to the terms of this agreement. We agree to sell the following, Male/Female Rottweiler puppy. Registered Name of Dog to be TMC's ( )_________________ Registration #__________________________)________Sex ______ D.O.B __________ Color: Black and Mahogany Sire: TO BE DETERMINED OFA: Dam: TO BE DETERMINED OFA: This contract is made between the seller TMC ROTTWEILERS 6009 Tindel Place Lake Wales, Fl. 33898 and the Buyer: ____________________________ ____________________________ ____________________________ It should be noted that the contract defines the responsibilities of the buyer and the seller and that it is written for the sole purpose of protecting the Rottweiler breed. It is hereby agreed by both parties that the following conditions will be met and that no other warranties or conditions are either expressed or implied. SHOW QUALITY AND PET QUALITY: _____This animal is being sold as a SHOW PROSPECT. male/female, But not required to be shown as some want the show look and guarantees, but do not plan on showing them. If this animal should develop a disqualifying fault according to the ADRK Standard for the Rottweiler then another Rottweiler may be purchased for $500.00. This will be done ONLY after said animal has been rendered incapable of reproduction and a letter from a veterinarian attesting to this fact has been send to TMC ROTTWEILERS by certified mail. OR _____This animal is being sold as a PET QUALITY with LIMITED AKC REGISTRATION PAPERWORK. It CANNOT be used for breeding unless, at the age of twenty-four months, it no longer has any disqualifying faults according to the ADRK Standards. An additional $500.00 will be required to get full registration of said animal for breeding/showing prospect. Said animal shall be registered with the AKC. TMC cannot be held responsible for the delays in processing registration papers by AKC and warrant that said animal is fully registrable with AKC. Deposits are required for TMC ROTTWEILERS to reserve all puppies. Once a deposit is made it is a commitment by the buyer to purchase said puppy and is therefore nonrefundable, as long as the gender of the puppy that is requested by the buyer is available. In the event that there is no puppy born or the gender you requested is not available, you will have the option of getting your deposit back or you can move to the next up coming litter of your choice as long as there is a pick available. This animal shall not be used for breeding purposes until it is at least twenty-four months of age, x-rayed clear of Hip Dysplasia, and passed at least a basic obedience course and has no disqualifying faults. Said animal shall carry the TMC Kennel name in all advertising or conformation shows and obedience trials. The name on the litter registration MUST CARRY THE SAME AS ON THIS CONTRACT and cannot be changed except by TMC Rottweilers. Ownership of said animal shall be transferred to the buyer in return for: $___________ TMC ROTTWEILERS warrants that said animal is the progeny of animals x-rayed clear of Hip Dyspolaysia. If said animal develops Hip Dysplasia, as evidence by OFA evaluation then TMC will do the following: BORDERLINE to MODERATE HIP DYSPLASIA- we will sell you another puppy out of mutually agreeable Sire and Dam for the price of $500.00 SEVERE HIP DYSPLASIA- we will give you another puppy out of mutually agreeable Sire and Dam for only the shipping charges. The above must be in a letter from veterarian and sent certified mail. If animal has the following Dysplasia pet must be rendered incapable of breeding. The puchase of the dog is a hobby and you should not be expected to gain income with this dog Buyer agrees to send photographs if at all possible of said animal at ages six, twelve, and twenty-four months of age to the address listed above to TMC ROTTWEILERS. So that we can forward them on to new buyers and to see them grow and develop. Buyer hereby releases from responsibility TMC ROTTWEILERS or its officers,agents, or employees from any and all liabilities and or damages by fault of said rottweiler after said rottweiler is in the care or possession of Buyer. These damages and liabilities include but are not limited to destruction of property and physical damage to any person or group of people. THE ABOVE AGREEMENT IS MADE AND SIGNED ON THIS __________________ BY TMC ROTTWEILERS AND THE BUYER TO ASSURE THE WELL-BEING OF SAID ANIMAL AND ITS PROGENY. SHOULD THERE BE ANY GROSS VIOLATIONS OF THIS CONTRACT, AND APPROPRIATE MUTUAL ATTEMPTS TO RESOLVE THE CONTRACT DISPUTE FAIL AND IT BECOMES NECESSARY TO ENFORCE THIS CONTRACT BY LEGAL MEANS AND IT BECOME NECESSARY TO ENFORCE ANY PART OF THIS CONTRACT BY LEGAL MEANS; ANY AND ALL ATTORNEY'S FEES, COURT COST, AND TRAVEL EXPENSES WILL BE THE RESPONSIBILITY OF THE BUYER. THIS CONTRACT WHILE BE DEEMED A LEGALLY-BINDING CONTRACT AND IS UNDER THE JURISDICTION OF THE STATE OF FLORIDA IN THE COUNTY OF POLK. IT IS FURTHER AGREED THAT THE PLACE OF VENUE IN ALL CASES SHALL BE POLK COUNTY, FLORIDA. We recommend that you keep them on puppy food for at least 6 mos. of age. |
